Terms of Service

1. Introduction

These terms of service (hereinafter "Terms") govern the rights and obligations of the parties in providing the Supermart service (hereinafter "Service") available at https://supermart.sk.

<strong>User</strong> is a natural or legal person who creates an account in the Service and uses it for business purposes (the Service is intended exclusively for B2B use — e-shop operators, agencies and similar).

2. Service Description

Supermart is a SaaS tool that:

• Loads e-shop product feeds (XML, CSV — Heureka, Shoptet, Google Merchant, Facebook Catalog and others),
• Uses artificial intelligence to generate text posts and graphics for social media,
• Schedules and publishes posts to connected Facebook pages and Instagram Business profiles,
• Provides performance analytics for published posts.

2a. Pricing and service contents

This section describes current prices of individual plans, what is included in the price and how the credit system works. Prices are stated including all fees within the EU.

Plans and prices overview

Prices are stated for end consumers. Provider Super Lead s.r.o., ID 52527743, is not a VAT payer. For payments in foreign currency, Stripe conversion rate on day of payment applies. The mentioned plans may be supplemented by upcoming packages (Lifetime Deal and others), about which the provider will inform on the website.

What the user gets in the plan price

The monthly plan price (Start / Growth / Pro) includes the following features and services:

• AI content generation — captions for Instagram and Facebook (including A/B variants), AI lifestyle graphics from products, hashtag suggestions.
• Social account connection — Facebook Page and Instagram Business via official Meta API. Automatic publishing and scheduling within Meta limits.
• Brand Kit — centralized brand settings (logo, colors, font, tone of voice, hashtags), applied automatically to every post.
• Content calendar — monthly post planning with edit/delete functionality, platform-based filters.
• UTM tracking — automatic addition of UTM parameters to product URLs for measuring conversions in Google Analytics.
• XML feed integration — connecting eshops via XML feed (Shopify, WooCommerce, Shoptet, PrestaShop, Magento, etc.) with automatic synchronization.
• AI image gallery — all generated images are stored in user gallery and can be reused without further credit consumption.
• Customer support — email support with response within 2 business days for Start and Growth, priority support within 24 hours for Pro plan.

How credits work

Credits are the unit of AI generation consumption within the service. Monthly credits are credited upon subscription renewal. Specific number of credits consumed for an action depends on the type of generation:

• 1 credit — generating a text caption (1 version).
• 3 credits — generating an AI lifestyle graphic from a product (1 image).
• Unused monthly credits do not roll over to the next month and are reset upon subscription renewal.
• Upon subscription cancellation, already purchased credits remain available until the end of current billing period.
• Upon exhausting monthly credits, user can continue generating only after renewal in new billing period, or upgrades to higher plan.

What is not included in the price

The plan price does not include:

• Advertising budget on social networks — Meta Ads, boosted posts, sponsored content. User pays these directly to Meta Platforms Ireland Limited.
• Domain hosting / SSL for user's eshop — the service works with user's existing eshop.
• Individual graphic work and custom design beyond automated AI generation templates.
• Consulting and marketing services — strategic consulting, campaign planning, copywriting beyond AI generation.

Changes to prices and plans

Provider reserves the right to change prices and plan contents. Price changes do not apply to already purchased (prepaid) periods. Provider will inform about price changes at least 30 days in advance via email to registered users and by publishing on the website. In such case, user has the right to cancel the plan without penalty effective on the change date.

3. Account Creation and Trial

The User creates an account by completing the registration form. After registration, the User has access to a free trial period without a credit card. The trial ends when the User's consumption reaches 30 credits (caption = 1 credit, AI lifestyle scene = 3 credits). After the limit is exhausted, the User must purchase one of the paid plans to continue using the Service.

4. Pricing and Payment

The current pricing is published at https://supermart.sk/#cennik. Payment is monthly in advance, by bank transfer to the account stated in the invoice with the variable symbol (format YYMM####). After payment receipt:

• The plan is activated for 30 days,
• Monthly credits are added,
• The User receives a confirmation email.

The Provider issues invoices electronically. The User agrees to electronic delivery of invoices to the email provided at registration and in the account.

5. Duration and Termination

The contract is concluded for an indefinite period, automatically extended by payment of the next monthly invoice. The User may stop paying at any time without a notice period — at the end of the prepaid period the account switches to free mode (no new credits, no data saved, but the account remains accessible for viewing).

The Provider may terminate the account without compensation if the User violates these Terms, in particular if:

• Generates content violating the laws of the Slovak Republic / EU,
• Distributes spam, hate speech, disinformation, deepfakes,
• Abuses infrastructure (DDoS, reverse engineering, scraping),
• Fails to pay an invoice more than 14 days past due.

6. Rights and Obligations

6.1 Provider

• Commits to keeping the Service available with a target uptime of 99 %, excluding planned maintenance,
• Is not liable for interruptions caused by third parties (Meta API, hosting, internet),
• Reserves the right to change functionality, while informing the User of significant changes by email in advance.

6.2 User

• Is solely responsible for the content published through the Service, in particular for copyright of product photos, truthfulness of claims, and compliance with Meta advertising policies,
• Commits not to share access credentials with third parties,
• Is responsible for the accuracy of billing information,
• Acknowledges that AI-generated content must be reviewed before publishing — the Provider is not liable for any errors in text or graphics.

7. Complaints

For technical issues or billing discrepancies, the User contacts the Provider at info@supermart.sk. We process complaints within 30 days of receipt. For valid complaints, the Provider will extend the plan validity by the time the service was unavailable, or refund a proportional part of the payment.

8. Affiliate Program

The User may join the affiliate program via the Affiliate section in the account. Commission is 20 % of every paid invoice of a referred client, paid recurring as long as the client pays. Tracking via 30-day cookie. Self-referral is prohibited — if detected, the Provider removes the commissions.

Minimum payout: 50 € pending, requested on demand via the affiliate dashboard button. Payout will be made to the specified IBAN within 7 business days of approval. Tax obligations for received commissions are solely on the User's side.

9. Limitation of Liability

The Provider is not liable for:

• Loss of reach, post rejection, or account blocking by Meta,
• Revenue decline due to publishing / not publishing a post,
• Spelling errors or inaccuracies in AI-generated content (review obligation lies with the User),
• Damages caused by third-party services (Meta, Anthropic, Google).

The Provider's maximum liability is limited to the amount the User has paid for the Service in the last 6 months.

10. Data Protection

Processing of personal data is governed by the separate Privacy Policy (GDPR) document.

11. Final Provisions

These Terms are governed by the laws of the Slovak Republic. The court of competent jurisdiction for resolving disputes is the general court of the Provider.

The Provider reserves the right to amend the Terms. The User will be informed of changes by email at least 14 days in advance. If the User disagrees with the changes, they may terminate the contract (stop paying) without penalty.

A non-business consumer is <strong>not</strong> an authorized user of the Service, as the Service is intended exclusively for business purposes.
